1. Who We Are

These Terms & Conditions govern the use of the Kinxsound Connect platform, operated by Kinxsound Worldwide BV (“Kinxsound”, “we”, “us”, “our”).

By accessing or using the Platform, you agree to be bound by these Terms & Conditions.

2. Definitions
  • User: Any individual or business accessing or using the Platform, including Requesters and Partners.
  • Requester: A User submitting a request for audiovisual equipment via the Platform.
  • Partner or Verified Partner: A business User verified and approved to list professional AV gear on the Platform.
  • Listing: Equipment offered for sale on the Platform by a Verified Partner.
  • Verification: The process by which Kinxsound Worldwide BV checks Partner eligibility before granting Verified Partner status.
3. Eligibility
  • The Platform is intended for Users aged 18 and older.
  • Partners are generally expected to be legally registered businesses. However, Kinxsound Worldwide BV may, at its sole discretion, allow private individuals to act as Partners.
  • The Platform is strictly limited to professional audiovisual equipment and is not intended for consumer gadgets or general goods.
4. Use of the Platform
  • Kinxsound Connect is a connection platform that enables Requesters to contact Verified Partners.
  • The Verified Partner badge confirms that the Partner has passed Kinxsound Worldwide BV’s checks, but does not guarantee the Partner’s reliability, financial stability, or product quality.
  • Kinxsound Connect is not a party to any contract, negotiation, payment, delivery, or dispute between Users.
5. User Conduct
  • All Users must act professionally and respectfully in all interactions on or through the Platform.
  • Prohibited conduct includes spam, harassment, abusive language, fake or misleading requests or listings, fraud, listing stolen or misrepresented equipment, misuse of contact details, and uploading content without the necessary rights.
  • Requesters may only use Partner contact details for the relevant request unless explicit consent is given.
  • Partners may only list equipment they legally own and physically hold in their own stock, including permitted consignment stock.
6. Intellectual Property & User-Generated Content
  • Partners represent and warrant that all images, photographs, videos, descriptions, and other content used in Listings are owned by them or used with valid permission or license.
  • Content must not infringe intellectual property rights, portrait rights, privacy rights, or other third-party rights.
  • Images must accurately represent the listed equipment.
  • Partners fully indemnify and hold harmless Kinxsound Worldwide BV against any claims arising from content misuse or infringement.
  • Kinxsound Connect hosts user-generated content and does not actively monitor or pre-approve all Listings.
7. Notice & Takedown

Kinxsound Worldwide BV may remove or disable content and suspend or terminate accounts upon notice of infringement or illegal content.

Repeated infringements may result in permanent removal from the Platform.

8. Privacy & Data

Personal data is processed in accordance with the Privacy Policy.

Requester data is shared only with selected Partners.

Partner data may be displayed publicly on the Platform.

9. Liability Disclaimer

Kinxsound Worldwide BV accepts no liability for failed deals, fraud, defective equipment, disputes, reliance on verification, user-generated content, technical issues, or cross-border matters.

All Users use the Platform at their own risk.

10. Termination & Suspension

Kinxsound Worldwide BV may suspend or terminate accounts for violations of these Terms.

11. Marketing Communications

Users may receive marketing communications and may unsubscribe at any time.

12. Updates to These Terms

These Terms may be updated at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by Belgian law.

Belgian courts have exclusive jurisdiction.

The English version of these Terms & Conditions prevails.
