1. Who We Are
  • These Terms & Conditions govern the use of the Kinxsound Connect platform, operated by Kinxsound Worldwide BV ("Kinxsound", "we", "us", "our").
  • By accessing or using the Platform, you agree to be bound by these Terms & Conditions.
2. Definitions
  • “User”: Any individual or business accessing or using the Platform, including Requesters and Dealers.
  • “Requester”: A User submitting a request for audiovisual equipment via the Platform.
  • “Dealer” or “Verified Dealer”: A business User verified and approved to list professional AV gear on the Platform.
  • “Listing”: Equipment offered for sale on the Platform by a Verified Dealer.
  • “Verification”: The process by which Kinxsound Worldwide BV checks dealer eligibility before granting Verified Dealer status.
3. Eligibility
  • The Platform is intended for Users aged 18 and older.
  • Dealers must be legally registered businesses with a valid VAT or company number.
  • The Platform is strictly limited to professional audiovisual equipment and not for consumer gadgets or general goods.
4. Use of the Platform
  • Kinxsound Connect is a connection platform that enables Requesters to contact Verified Dealers.
  • The Verified Dealer badge confirms that the Dealer has passed Kinxsound Worldwide BV’s checks, but it does not guarantee the Dealer’s reliability, financial stability, or product quality.
  • Kinxsound Connect is not a party to any contract, negotiation, payment, delivery, or dispute between Users.
5. Fees
  • Submitting a request is currently free of charge for Requesters. Kinxsound Worldwide BV reserves the right to introduce fees for Requesters in the future with at least 30 days’ notice.
  • Dealers are subject to an annual validation fee and membership fee, the amounts of which may vary from year to year at the discretion of Kinxsound Worldwide BV. Additional fees may apply for extra listing slots.
  • All payments of the validation fee and membership fee must be made before activation of Verified Dealer status or listing publication.
  • Kinxsound Worldwide BV offers a 30-day refund policy from the date of the first payment when becoming a Verified Dealer, no questions asked. After 30 days, all fees are strictly non-refundable. Renewals and additional fees (such as extra slots) are non-refundable.
  • If the annual validation renewal fee and membership renewal fee are not paid within 10 days after the due date, Kinxsound Worldwide BV reserves the right to suspend or terminate the Dealer’s account and remove all Listings from the Platform.
6. User Conduct
  • All Users must act professionally and respectfully in all interactions on or through the Platform.
  • Prohibited conduct includes:
    • Spam, harassment, or abusive language.
    • Fake or misleading requests or listings.
    • Fraudulent behavior or attempts to scam other Users.
    • Listing stolen, counterfeit, or misrepresented equipment.
    • Breach of privacy, including misuse of contact details obtained via the Platform.
    • Requesters may only use Dealer contact details for the relevant request, unless the Dealer provides explicit consent for further use.
    • Dealers may only list equipment they legally own and have in their own stock. Consignment stock is permitted provided it is physically held in the Dealer’s own stock and under their control.
7. Privacy & Data
  • Personal data is processed in line with our Privacy Policy, available on the Platform.
  • Requester data will only be shared with the Verified Dealer(s) they choose to contact.
  • Dealer data (such as business name, country, and listings) is displayed publicly on the Platform.
8. Liability Disclaimer

Kinxsound Worldwide BV accepts no liability whatsoever for:

  • Failed or cancelled deals, fraud, or scams.
  • Defective, delayed, or undelivered equipment.
  • Misrepresentation or disputes between Users.
  • Losses resulting from reliance on the Verified Dealer badge.
  • Technical errors, downtime, bugs, or data loss on the Platform.
  • Cross-border issues including customs, import/export restrictions, or taxes.
  • All Users use the Platform at their own risk.
9. Termination & Suspension

Kinxsound Worldwide BV may suspend or permanently remove a User’s account at its discretion in the event of:

  • Non-payment of fees (for Dealers).
  • Submission of false or misleading information.
  • Fraudulent or prohibited Listings or Requests.
  • Harassment, abuse, or spam.
  • Breach of these Terms & Conditions.
  • Suspended or terminated Users are not entitled to refunds beyond the initial 30-day refund policy for first-time Dealer activation.
10. Marketing Communications
  • Users may receive newsletters, marketing emails, and promotional communications from Kinxsound Connect.
  • Users can unsubscribe from marketing communications at any time by using the unsubscribe link in the emails or contacting us directly.
11. Updates to These Terms
  • Kinxsound Worldwide BV reserves the right to update or amend these Terms & Conditions at any time.
  • Changes will be notified to Users via email or through the Platform.
  • Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law & Jurisdiction
  • These Terms shall be governed by and construed in accordance with Belgian law.
  • Any disputes shall be submitted exclusively to the courts of Belgium.
  • These Terms are drafted in English. In case of translation, the English version prevails.
